‘Trial by Military Courts inevitable but banning political party unjustified’

KARACHI: Hashmat Habib President Tehreek-e-Tahaffuz-e-Adlia said May 9 attack on Military installations and Jinnah House is an open and shut case therefore Imran Khan and his supporters' trial is necessary. If these people were able to shatter allegation they may get relief from Military Courts and judiciary cannot interfere.

Hashmat Habib said so far as military trial is concerned it is admissible under Pakistan Army Act 1952 and other laws. Military trial under some specific circumstances is conducted against principle of Natural justice and even procedure laid down in Army Act but now situation is changed.

I, myself had appeared as defense counsel in Jhanda Chichi case and Total Petrol pump blast case (in Musharraf regime) but even then I could get release of Shazia Mubashar and subsequently from Supreme Court got remission for one accused Rana Naveed. His death conviction was converted to life imprisonment.

He said political party is guaranteed by Constitution. Issue to finish political party may be left to citizens of Pakistan. Ban on PTI and Imran Khan along with his co-accused military trials is two different issues. Our past experience tells us that no political party can be finished which is banned on very serious proof. National Awami Party and Jamaat-e-Islami and religious groups were banned. Even after ban, it may be lifted but party workers join hands under new name formations, he added.
