KARACHI: “I Professor Muhammad Quadir Hussain s/o of Muhammad Khawaja Husain am a Nuclear Physicist, having received the Degree of M.Sc. in Nuclear Physics and having worked as a Nuclear Scientist under Pakistan Atomic Energy Commission in Pakistan Institute of Nuclear Science and Technology (PINSTECH) Rawalpindi.

The defendants (Dr. Abdul Qadeer Khan, P.A.E.C, and others) and persons working on their behalf are still using my invention for separation of Uranium-235 from natural uranium for atomic weapons without my authorization and permission which is quite illegal.” The unsung hero of 28th May 1998 “Youm-e-Takbeer” Professor Muhammad Quadir Hussain submitted the above affidavit in the High Court of Sindh under Order 39 Rule 1&2 read with Section 151 of Civil Procedure Code on 26th January 2009. For the facts and reasons disclosed in the affidavit he prayed that this Court may grant temporary injunction against the defendants restraining them, their servants, functionaries, assigns, agents or any other persons working on their behalf from using the plaintiff’s invention for the production of Uranium-235 for use in atomic weapons without authorization and permission of the plaintiff in the final disposal of the Suit No.13/2000.  He said the factual evidence of use of his patented invention has been found when Pakistan conducted five (5) nuclear explosions on May 28, 1998. This day in TV Khabarnama describing history of Pakistan Uranium Enrichment, an Apparatus was shown on television.

  The apparatus is employed only by my process in separating the isotopes of Liquid Uranium Hexa fluoride. I have a recording of the said Khabarnama. The photographs of the apparatus were published in the “Weekly Takbeer” of July 9, 1998. The fact that this publication has gone unchallenged and not refuted by the defendant confirms the use thereof by the defendants unauthorizedly without my consent and permission. This fact was also confirmed by Muhammad Zafar, the then Controller of Patents. The Order of with-holding the patent was intended to enable the defendants to go on using my invention without my permission and without paying any royalties to me. The said Muhammad Zafar had admitted the unauthorized use of my process when he was contacted by me on telephone on 27-03-1982.  This fact was also published in the Weekly Takbeer dated 14-09-1989.   Muhammad Quadir Hussain further disclosed that having developed this method he had approached the then Prime Minister by letter dated August 14, 1974.  It was forwarded through Ministry of Defence to Pakistan Atomic Energy Commission. By letter dated 6th January 1975, P.A.E.C. requested me to contact Dr. Riazuddin Member Technical, P.A.E.C. and meeting took place between me and Dr. Riazuddin at Karachi on November 20, 1976.
