State fails in discharging its obligations a tragedy: CJ IHC Athar Minallah

ISLAMABAD: Chief Justice (CJ) Islamabad High Court (IHC) Athar Minallah has said it is our tragedy that state has failed in discharging its obligations. “Half of our life passed in dictatorship. We have repeatedly said in our decisions that there is no rule of law. We have mentioned in decisions that law is only for elite.
It is responsibility of political leadership that it should not bring their disputes in courts and fortify Parliament”, he said this while addressing a full court reference held in his honour by IHC here. He held it is also binding on judiciary to keep in view norms of distribution of powers. We have taken oath for protection of Constitution.
There can be supremacy of Constitution only when mindset changes. Political leadership can strengthen supremacy of Constitution. Accountability of our institution is with public scrutiny, he added. People should have trust on judiciary, he remarked. We have a specific role.
We can only give decision. I don’t want to take any credit, he said adding there was nothing possible without colleague judges and dynamic bar. IHC is not like other high courts, he remarked. It has a separate status. This is not court of one area. It represents federation. What incident has been talked of with reference to lawyers, law will take its course therein, he observed.
IHC reports have proved them professional reporters, he underlined. Designated CJ IHC Aamir Farooq said CJ Athar Minallah has played vital role in lawyers movement. He placed special focus on human rights issue. He visited central jail in connection with jail reforms.
