SHC to hear Appeal against Registrar Cooperative Societies in Karimabad Society case

KARACHI: Three members of the Karimabad Society filed an Appeal in Sindh High Court against the Registrar Cooperative Societies Sindh and others being aggrieved and dissatisfied with the impugned order dated 21-02-2024 passed by the Vth Court of Senior Civil Judge Karachi West. They requested to set aside the above order and call for the record and proceedings of their case in accordance with law. 

The appellant members are Hassan Ghulam Hussain, Shabbir Nathwani and Mohammad Ali Damani. They had prayed the court on 25-03-2024 to restrain the Registrar Cooperative Societies from conducting fake/ biased election in general body meeting held on 7-05-2023 by misusing their powers, which was complete violation of Cooperative Societies Act. 

They requested the Court to declare the current electoral process null and void and direct the defendants to reschedule the electoral process as per laws/ bye laws by giving fair opportunities to the members of the society under the supervision of Nazir of the Sindh High Court on immediate basis.     

According to appellants their suit was filed prior to the said elections alongwith an application but the learned trial Court totally failed to restrain respondents from conducting illegal elections. The suit was filed against an illegal act in which the respondents unilaterally passed/ amend some bye-laws without adopting through proper channel or inviting any general body meeting. The said acts of the respondents were biased but the learned trial Court totally failed to resolve the disputed issues in accordance with the law and arbitrarily rejected the instant plaint illegally.
