Shariat Court disposes of review plea against Imran-Bushra nikah

ISLAMABAD: Federal Shariat Court disposed of review plea against nikah of PTI Chairman Imran Khan with Bushra Bibi, stating court had already given its verdict.

FSC in February 2022 had dismissed petition seeking decree against Imran Khan’s marriage. Giving its ruling on review plea, FSC Chief Justice Iqbal Hameedur Rehman, heading three-judge bench, remarked that court had already given its verdict in case related to Family Act 1964.

CJ observed that case against FSC judgement has already pending before Supreme Court’s Shariat Apellate Bench. “So, jurisdiction to hear review plea is limited. It would be appropriate if you move Shariat Apellate Bench,” he told applicant.

Justice Syed Anwar remarked that knowledge is not anyone’s property. “It would be better if you consult lawyer,” FSC judge advised applicant Shahid Orakzai.  In its 2022 verdict, FSC had ruled that petition against Imran Khan’s marriage didn’t suit in eyes of law as it was not filed in accordance with Federal Shariat Court (Procedure) Rules 1981.

Court had also observed that petitioner had failed to mention any specific provision of law being repugnant to injunctions of Quran and Sunnah as required by Constitution and termed it non-maintainable.
