SC should admit its past mistakes of endorsing martial laws: CJP

Islamabad: During hearing of Supreme Court Practice and Procedure Act case, Chief Justice of Pakistan Justice Qazi Faez Isa made compelling remark, highlighting havoc being wrought by individuals wielding unchecked power.
He astutely observed that when martial law is imposed, solemn oath taken by judges often fades into oblivion. In contrast, when Parliament enacts laws, judiciary swiftly reacts, holding lawmakers accountable to their oath.
CJP boldly asserted that apex court should acknowledge its past mistakes concerning its endorsement of martial laws. Critics, particularly lawyers, have historically voiced concerns about top court’s perceived misuse of its jurisdiction under Article 184 (3) of Constitution.
Full court bench of Supreme Court is hearing petitions challenging SC (Practice and Procedure) Act 2023.
During session, CJP made point that Act which was passed by Parliament, does not take away chief judge’s authority by giving it to three-person committee.
In its short order, 15-member full-court bench lifted stay order over implementation of Act.
