ISLAMABAD: The Supreme Court (SC) Registrar Office has returned petitions filed by JI, the Supreme Court Bar Association (SCBA), and Ibadul Rehman, which sought a court order for holding a general election within 90 days.
Objections have been raised on all the petitions with common points.
The objections point out that the petitioners failed to clarify whether their petitions meet the norms set for public interest under Article 184 (3) of the constitution and how they can directly file a petition under this constitutional jurisdiction of the court. Additionally, it questions the authority of the petitioners to exercise this extraordinary ambit of the court.
Furthermore, the objections state that the petitioners included the President of Pakistan as a respondent in this case, which cannot be done under Article 248 of the constitution.
Another objection raised is related to the preparation of notices for the respondents, which have not been prepared according to the law applicable to constitutional petitions. The petitioners have been advised to approach the proper forum before seeking relief from the SC.
Lastly, it is noted that the certificates attached to the petitions do not meet the legal requirements and do not conform to SC rules 1980, particularly the certificates on page No 19.
