SC declares Review of Judgments and Orders Act null and void

ISLAMAABAD: Supreme Court (SC) announcing reserved judgment in Review of Judgments and Orders Act case has declared this Act null and void.  SC while declaring Review of Judgments and Order Act 2023 illegal has nullified Supreme Court Review of Judgments and Orders Act-2023.

 

Parliament had given right of review appeal before larger bench through Act. Three member bench of SC presided over by Chief Justice of Pakistan (CJP) Umar Ata Bandial announced decision. SC had reserved judgment on June 19 after six hearings of case.  Justice Ijazul Ahsan and Justice Munib Akhtar were part of this 3-member bench. Parliament had approved Review of Judgments and Order Act-2023. Parliament had given right to file review appeal before larger bench through an Act. 

 

Respondent was given right to appeal against decision of cases pertaining to Article-184/3 under Act.

 

It is compulsory that number of judges of bench hearing appeal under Supreme Court Review of Judgments and Orders Act should be more than number of judges of bench which hears case.

 

In Review and Judgment Act, respondents will be allowed to hire new lawyer to file appeal. Under this Act review appeal will be heard by larger bench in cases of public interest. Other lawyers had challenged this Act.  In Punjab Election Case government had raised objection over bench by presenting Review and Judgment Act.
