Pakistan Tehreek-e-Insaf (PTI) Chairman, Imran Khan, has filed a petition in the Islamabad High Court (IHC) seeking the suspension of the trial court's verdict in the Toshakhana case.
This development comes over a month after the IHC had previously suspended Imran Khan's three-year sentence in the Toshakhana case.
The petition was submitted by senior lawyer Sardar Latif Khosa under Section 561-A of the Code of Criminal Procedure, which pertains to the inherent power of the high court.
The petition argues that the inherent powers of the High Court are broad and undefined, allowing it to make orders in the interest of real and substantial justice. It contends that the omission of not recording the contentions of the petitioner's counsel regarding the suspension of the impugned order on August 5, 2023, and the subsequent failure to mention it in the order on August 28, 2023, is a glaring oversight.
Furthermore, it points out that the IHC's verdict on August 28 had only suspended Imran Khan's sentence and not the trial court's order. The petition requests the court to rectify this omission.
The petition also argues that the Election Commission of Pakistan (ECP) issued the disqualification order hastily, despite the conviction not having reached its finality.
Regarding the Toshakhana verdict, on August 5, the District and Sessions Court sentenced Imran Khan to three years in jail in the Toshakhana criminal case and imposed a fine of Rs 100,000. Additionally, the court declared the former prime minister ineligible to hold public office for five years. The court's verdict was based on findings that Imran Khan had deliberately provided false information about Toshakhana gifts to the ECP and was guilty of corrupt practices."
