Islamabad: Law Minister Azam Nazeer Tarar said that former Prime Minister Nawaz Sharif and Pakistan Tehreek-e-Insaf’s estranged leader Jahangir Khan Tareen cannot benefit from new law regarding review of judgments.
Speaking to private TV channel Tarar said that Supreme Court (Review of Judgements and Orders) Bill 2023 will not benefit Nawaz and Tareen as they both have exercised their right of review against their sentences.
Earlier, Attorney General for Pakistan Mansoor Usman Awan during hearing of Punjab polls case in Supreme Court apprised court that law for review of suo motu judgements had come into effect.
Supreme Court Review of Judgments and Orders Bill 2023 came into force Friday after President Arif Alvi’s assent. Law states that for reviewing suo motu judgment, bigger bench than one that issued order will hear case.
“In case of judgments and orders of SC in exercise of its original jurisdiction under Article 184 of Constitution, scope of review on both facts and law, shall be same as an appeal under Article 185 of Constitution,” law reads. Law Minister said that court’s verdict was considered final one under Article 184(3), stating, “There is no room for revision or curative review in our law”.
“Under new law, common people would be given relief under Article 184(3),” he added. He said that debate had taken place in National Assembly regarding Supreme Court (Review of Judgments and Orders) Act. “Debate was broadcasted live when Act was presented in National Assembly and Senate.”
