Minister reacts to SC’s detailed judgment in reserved seats case

ISLAMABAD: Minister for Law Azam Nazeer Tarar reacting to Supreme Court’s (SC) detailed judgment in reserved seats case said that decision on case was contrary to government’s plea.
Azam Nazeer during press conference said that review appeals have not yet become ineffective and matters will continue according to country’s laws. If there is no Parliament, President can issue ordinances and Supreme Court itself has said that Election Commission has authority. Despite detailed decision, all our questions remain as they were, he said. All judges in court are equal and seniority does not dominate decisions. There were only two points in hearing: whether reserved seats should go to Sunni Ittehad Council or not, who filed case and what was requested. Two judges who wrote dissenting notes were also strictly mentioned in decision, said Minister. Pakistan Tehreek-e-Insaf was neither party in Election Commission, Peshawar High Court, nor Supreme Court.
According to current laws, how these reserved seats are to be allocated is not in decision, he highlighted. This is not force, nor is it chain of command; it is court. Today’s decision has further strengthened review petitions. He said that process of an independent candidate joining any party is irreversible.
An independent candidate has to join party within three days of winning his seat. He said that legislation of Parliament is above decisions of Supreme Court.
