KARACHI: The members/ residents of Lucknow Cooperative Housing Society, located at Sector 31-E, Korangi has dispatched legal notice U/s 115 of Cooperative Societies Act 2020 to Secretary and Chairman Sindh Cooperative Housing Authority, Government of Sindh against promotion of harassment by land grabbers mafia patronized by few govt. officials.   

That notice said it is crucial to emphasize that since March 2023 till to date the Department had appointed back to back more than 10 Administrators; however no one was able to conduct peaceful and democratic elections for handing over the charge of the Society to the duly elected members and management committee.

It is prudent to highlight that since 2017 the management of the society made arrangements of fake election with involvement of the Registrar Cooperative, since his assumption of control over the affairs of the Society, multiple Administrators have been appointed under Secretary’s directives. However, these appointments have not only failed to fulfill their mandated duties, such as conducting elections and ensuring proper governance, but the appointed Administrators had also been found complicit in gross illegalities, irregularities, maladministration, mismanagement, and the misuse of powers and funds of the Society.

Besides such actions, coupled with inactions on your part, they have directly contributed to significant financial losses, emotional distress, and irreparable harm to the interests and rights of our Clients and other members of the Society. In this connection we are hereby repeating our deep concern against your recent appointed Syed Javaid Ali Shah, as in charge/ administrator vide notification No. SO (SA)II(11)/2000/Pt-IV/470 dated 03.11.2023 and repeated Notification No. SO(SA)II(11)/2000/Pt-IV/NIL dated 11.12.2024. 

With all acknowledgments, he deliberately handed over the society office to the corrupt superseded committee men and supporting land mafia for his momentary gain, whereas the society office has become a real-estate business point of the forged / fabricated documents. He allowed the illegal constructions/ subdivisions of the plots Nos. F-52, F-115, F-83, F-83/3, E-154 etc against KB&TPR 2002 and the Layout of the society. He misleads the enquiries through false verifications to favor the land mafia which was subsequently used in the concealment of the civil courts/ cases against the real allottees.

In the light of fact mentioned above said notification is to be withdrawn with immediate effect as the elections through such a dishonest administrator/officer will be highly objectionable and not acceptable at all. Our letter dated 19.9.2024 regarding detailed Audit Report of your appointed administrators since 16.03.2023 till to date, is still pending with no compliance. Your actions, omissions, and the dishonest appointments of Administrators constitute clear violations of the rights of the executants of special power and other Society members as guaranteed under the Constitution of Pakistan. Therefore, such conduct is neither tolerable nor excusable under any circumstances and shall be subjected to immediate legal challenge to protect the lawful rights and interests of the Society members. 

In view of the above, you are hereby strictly advised and called upon to ensure the immediate initiation and conclusion of elections for the Society’s governing body within seven (07) days by any other honest Election Officer from the date of receipt of this notice.

Cease and desist taking any coercive, unlawful, or arbitrary actions concerning the property/ land of the Society, including but not limited to its amenity and commercial plots, provide a detailed explanation justifying the illegal appointments of some private persons as Administrators of the Society since March 2023. Failure to comply with the aforementioned demands shall leave us with no alternative but to pursue all appropriate legal remedies against you and your department, including but not limited to filing a Constitutional Petition, initiating civil and criminal proceedings, lodging complaints and FIRs, and seeking injunctive relief against you which shall solely at your cost and expense, the legal notice concluded.
