LHC dismisses petition seeking order to stop holding polls in 4 Islamic months

LAHORE: Lahore High Court (LHC) has dismissed petition seeking court's order to stop holding election during four sacred months of Islamic calendar besides declaring clause 3 of section 170-A unconstitutional.

Justice Raheel Kamran of LHC while declaring petition from a citizen Fahd Aziz non maintainable issued written order. Petitioner had taken plea 4 months among 12 Islamic calendar months are highly sacred. Months of Ziquad, Zilhaj, Rajab and Muharram were sacred, necessitating utmost respect. Holding elections in past during these months had led to incidents of violence and killings, he said. Clause 3 of Section 170 (a) of Election Act 2017 was against 3 Islamic principles.

It has been said in court's decision that petition seeking court's order to declare clause 3 of Section 170 (a) of election act 217 Un-islamic is not maintainable.

Under article 203 G of Constitution, Supreme Court or any High Court is not authorized to interfere in powers of Federal Shariat Court.

SC said in its decision that under Article 203 -D of Constitution powers rest with Federal Shariat Court to declare any law against Quran and Sunnah.
