Judicial remedy lies only in establishing rule of law: Hashmat

KARACHI: Hashmat Habib President Tehreek-e-Tahaffuz-e-Adlia said it is clear that all judges of Supreme Court or members of any Judicial forum are equal therefore Chairman or Chief should not be given dictatorial power in affairs of these organisations. He said remedy lies in establishing rule of law not rule of thumb.

Referring to controversy that erupted regarding proceedings of Judicial Commission of Pakistan he said Chief Justice of Pakistan addressed at opening ceremony of new judicial year and subsequent deliberations by two judges revealed necessity to reconstruct mode of Judges’ selection which is although unfortunate but may be a blessing for judges to do justice without fear or favour. He viewed situation that arose on account of controversy and said it is need of hour that entire Judicial system is reviewed and it should be replaced by Islamic Judicial system which is command of objective resolution.

He said all Judges were not in support of candidates proposed by Chairman for their appointment as judges of Supreme Court. He said Justice Qazi Faez Isa and Justice Sardar Tariq Mehmood swiftly pointed out this alarming situation in their joint letter of September 15, 2022. Its contents appear as curators and also food for thought for government, Parliament and civil society. Pick and choose practice should be stopped if it’s done so then there is a possibility of doing justice instead of deciding cases as per personal thinking of judges which is now being bracketed as conscious of judges although their oath requires to decide cases as per law of Constitution.
