KARACHI: Imran Khan is in better position and enjoying all comforts including meeting with mob of lawyers in prison because his trial is being conducted in jail premises, Hashmat Habib President Tehreek-e-Tahaffuz e Adlia said.
When you claim rule of law then learn to maintain order and discipline otherwise neither lawyer cannot do anything nor can court facilitate violating applicable rule of prison.
Under trial or convict prisoners are dealt in accordance with Pakistan Prison Code to maintain discipline and order and jail superintendent acts like king thus Imran Khan is also subject to these rules and no court can interfere, he added. Hashmat Habib said if we believe in rule of law then raising hue and cry is immaterial.
He said courts also act in accordance with Constitution and law but nowadays narration is being built up that Imran Khan is being denied from interviews with his lawyers, family members and followers.
He said Imran Khan is entitled for superior class in prison, if he breaks order and discipline only remission can be withdrawn by jail superintendent. He said prisoner is only deprived of his liberty but entitled for all facilities to live in prison enjoying all rights and facilities provided under rules.
He said so far as right to writing letters and interviews are concerned it is provided under rule 265 and being superior class prisoner he shall be allowed to write one letter and have one interview weekly. Both letter and interview are interchangeable. He said on urgent occasions such as death or serious illness in prisoner’s family this rule may be relaxed at discretion of superintendent. Under rules number of persons who may visit prisoners at any given times should be limited to six. Discussion of political matters shall not be allowed at these interviews.
He said subject matter of all letters shall be strictly limited to private affairs and shall not contain any reference to prison administration and discipline, other prisoners are politics. Further publication of matters discussed at interview or of substance of letters received from prisoners shall entail withdrawal or curtailment of this privilege, lawyer added.
