Imran Khan challenges IHC's Toshakhana verdict in Supreme Court

ISLAMABAD: PTI Chairman Imran Khan challenged Islamabad High Court (IHC)'s decision to send back Toshakhana case to district and sessions court for retrial.
In his application submitted in apex court, Imran Khan prayed court to annul IHC's decision of sending Toshakhana case back to retrial court with direction to decide case within seven days.
Imran Khan maintained that declaring admissible Election Commission of Pakistan's plea for criminal proceedings was also against law. Powers of Mianwali district judge cannot be exercised by district judge of Islamabad, he added.
District and sessions court in Islamabad on Thursday accepted Imran Khan's plea for personal exemption from Toshakhana case hearing, ordering his appearance before court today (Friday).
Sessions court granted an exemption to PTI Chief after his counsel Gohar Ali Khan told Additional District and Sessions Judge Humayun Dilawar that his client was due to appear before Lahore High Court and requested court to fix any date for hearing after July 10.
Despite request for extended exemption, court granted Imran Khan a day-long exemption while instructing his counsel to ensure Imran Khan's presence in court following day.
Court took up case today couple of days after IHC Chief Justice Aamer Farooq overturned ruling of local court against Imran Khan's challenge to maintainability of Toshakhana case and remanded case back to trial court to re-examine matter within seven days.
