IHC removes terror clauses from case against Imran Khan

ISLAMABAD: Islamabad High Court (IHC) while ordering to remove terrorism clauses from case against PTI Chairman Imran Khan has transferred case to Sessions Court. 

Case pertaining to threatening female judge came up for hearing before a two members bench of IHC presided over by Chief Justice (CJ) Athar Minallah and comprising Justice Saman Rafat Imtiaz.  Special prosecutor Rizwan Abbasi and Suleman Safdar counsel for Imran Khan appeared in court. 

Special prosecutor Raja Rizwan Abbasi told court in his arguments JIT declared terrorism case against Imran Khan in order. Court had directed JIT to inform it about its opinion after investigation.  Court inquired from prosecutor “Have you seen decision by 7 members bench of Supreme Court (SC). Prosecutor replied yes he has seen.

Court inquired tell us JIT has given what opinion in this case. Court while addressing prosecutor said you could not find something more than a speech during investigation. SC has interpreted terror law. Prima facie not a single clause seems to be applicable in this case.  Court removed terrorism clauses from case against Imran Khan after hearing arguments of lawyers of respondents.  

Prosecutor told court JIT opinion is that terrorism clause is applicable in this case.  Suleman Safdar counsel for Imran Khan gave references from decisions of SC in his arguments. Points of terrorism cases are very clear in decision of 7-member bench of SC. No grounds of SC decision in present case are there.  Those all elements are not there in case registered against Imran Khan. Terrorism case cannot be made against Imran Khan in light of SC decisions. This case will depict what image of Pakistan in world. 

Court inquired is registering terrorism case on these words tantamount to make joke of anti-terrorism law.  Counsel for Imran Khan said terrorism clauses have been ridiculed by registering this case. Imran Khan said to female judge and police officers about legal action.  Prosecutor

Raja Rizwan Abbasi said section 186 has been excluded from case against Imran Khan. 

Counsel for Imran Khan told court police are saying challan has been prepared against Imran Khan. This court prevented police from filing challan but police have prepared challan.
