IHC judges’ letter: Ex-CJP Jilani refuses to head inquiry commission

ISLAMABAD: Former CJP Justice (retired) Tassaduq Hussain Jillani has refused to head inquiry commission on IHC judges’ letter.
Last week, Cabinet named Tassaduq Hussian Jillani to head inquiry commission to probe allegations of IHC judges of interference by intelligence agencies.
In letter penned to PM Shehbaz Sharif, former CJP said he has reviewed letter penned to Supreme Judicial Council and it does not fall under Article 209. I thank Cabinet members, CJP Justice Qazi Faez Isa and Justice Mansoor Ali Shah for expressing confidence in me, letter read.
“I have gone through afore-stated letter of six judges and terms of reference approved by Cabinet as well as relevant constitutional provision (Article 209).
Since letter is addressed to members of Supreme Judicial Council (SJC) and its chairman Chief Justice of Pakistan, it would be violation of judicial propriety for me to inquire into matter which may fall within jurisdiction of constitutional body which is Supreme Judicial Council or Supreme Court of Pakistan itself.”
I am also of view that terms of reference for inquiry are strictly not germane to subject matter of letter June 25, 2024, ex-CJP said in his letter.
“Towards end request in letter is for an “Institutional consultation” in terms of mechanism suggested in said letter”.
For afore-referred reasons, I recuse myself to head commission and proceed with inquiry, ex-judge said in his letter to PM.
