FSC may be replaced by Constitutional Court: Lawyer Hashmat Habib

KARACHI: Federal Shariat Court should be abolished being useless and its Jurisdiction can be given to bench of 5 Judges established as Constitutional Court.
Hashmat Habib President Tehreek e Tahaffuz e Adlia said, already pointed out that neither age of Judges should be enhanced nor tenure of Chief Justice be fixed. However 4 Judges Panel may be good proposal for appointment of Chief Justice. Al jihad trust case regarding seniority can be considered along with fitness, he said. He said that over confidence of government was main cause for its defeat in introducing judicial package in Parliament.
He seriously believed that incompetency of Govt legal team was dragging country towards lawyers protest although lawyers protest under garb of independence of Judiciary will be proved, if launched, as an exercise in futile. Hashmat Habib said as per Charter of Democracy establishment of Constitutional Court at Federal level is not an issue but it is necessity. He said creation of new Constitutional Court will be burden on exchequer because this purpose can be achieved without disturbing present setup of Supreme Court.
He suggested that bench of 5 Judges be named as Constitutional bench under Chief Justice of Pakistan as its administrative head. There is already setup of Appellate Shariat Bench for disposal of appeals against Judgments of Federal Shariat Court, he added.
