Elahi gains ground in legal battle against ACE

LAHORE: In long legal battle, where Anti-Corruption Establishment (ACE) contested magisterial court’s decision to send former Chief Minister of Punjab and PTI Central President Chaudhry Pervaiz Elahi on judicial remand instead of physical remand, Elahi’s legal team gained ground as he was resent to judicial lockup.

Earlier this month, Elahi was arrested by ACE once again, this time on alleged charges of conducting illegal recruitments within Punjab Assembly during his tenure as Punjab CM.  Pervaiz Elahi said he was being kept in small room in prison for past 10 days where his health has deteriorated. “I am unwell and for 10 days I have been locked up in tiny room,” he told journalists ahead of his hearing at local court.

“Fan in room malfunctions,” he added “I am not being permitted to meet my family.” Meanwhile, Elahi’s legal team challenged district court’s order in Lahore High Court (LHC), which suspended it and issued an order seeking responses from concerned quarters. As proceedings commenced, Investigation Officer sought to extend Elahi’s physical remand during course of investigation.  Elahi’s legal counsel, Rana Intizar Hussain strongly opposed physical remand request, arguing that FIR had been registered on basis of source that had not been disclosed to person accused. 

He asserted that no inquiry was conducted and no statement of allegations was given to accused which was sheer violation of Article 10-A of Constitution.
