Detailed verdict: SC reverses clock in Imran arrest case citing fundamental right

Islamabad: Supreme Court of Pakistan (SCP) issued detailed verdict of Imran Khan’s arrest in NAB’s Al-Qadir Trust case, in which apex court ordered to ‘reverse clock’ terming arrest as violation of fundamental rights.

According to verdict, in facts and circumstances of case and to remedy injustice that had been visited upon petitioner, SC took decision to reverse clock and ordered police to produce him before High Court so that his prearrest bail application in AQT Case may be heard by High Court for decision.

SC considered view that only such course of action will caution police officials/investigating agencies to abstain from similar conduct in future that infringes both dignity, sanctity and safety of courts and fundamental right of citizens of Pakistan to enjoy liberty in accordance with law.

Petition was converted into appeal and disposed of in terms of directions issued in SC short order.

SC division bench wrote that Attorney General submitted that an intervening event had taken place i.e., an Accountability Court had granted an eight-day physical remand of petitioner to NAB which order had not yet been challenged by him.
