Court to indict Imran in Toshakhana reference on May 10

ISLAMABAD: Sessions’ Court rejected Pakistan Tehreek-e-Insaf (PTI) Chief’s plea challenging criminal proceedings against him in Toshakhana reference and fixed May 10 to indict him in case.
Additional Sessions Judge Humayun Dilawar announced verdict shortly after reserving it. Sessions Court’s ruling came after hearing detailed arguments from Election Commission of Pakistan’s counsel Advocate Amjad Pervaiz and Imran Khan’s lawyer Khwaja Haris. Judge has summoned PTI chief in-person on May 10. During hearing, Imran’s lawyer presented his arguments on admissibility of ECP’s complaint and raised an objection regarding jurisdiction of court.
Haris read out sections 190 and 193 of Election Act in court. Lawyer maintained that application against maintainability of case was filed under Section 190A of Election Act. He added that Sessions’ Court could not hear matter directly. Haris stated that case being admissible and under trial were two different things and that if case was referred under Section 190, court could then hear it. PTI counsel provided several case references to court.
Court had earlier fixed February 7 as date to indict PTI Chief in case. However, process was deferred till February 21. Taking up matter on day, Imran’s indictment was once again deferred as sessions court approved his exemption from appearance on medical grounds till February 28.
