CJP, likeminded judges should act in accordance with law: lawyer Hashmat Habib

KARACHI: Hashmat Habib President Tehreek-e-Tahaffuz-e-Adlia said conduct of likeminded judges under command of Chief Justice of Pakistan raised many questions involving denial of principle policy to ensure inexpensive and expeditious justice which is apparently possible through military courts in comparison with civil courts as such guarantee is given under Pakistan Army Act 1952 and rules made there under.
Senior lawyer said rule of law demands equal treatment and obeying Constitution, therefore, pending application should be disposed of without wastage of time because Supreme Court is conscious about its legal and constitutional duty. Case is simple neither Supreme Court can act against its oath nor amend Army Act and rules which is domain of Parliament.
He said that under garb of military trial of civilian accused Supreme Court in fact is adopting delaying tactics to defeat Justice and save PTI Chairman from military court.
Hashmat Habib said by delaying disposal of applications against military trial in fact fundamental rights of arrested 102 accused persons in episode of May 9 which has attracted involvement of civilians although number of accused persons who are involved in instigating and facilitating crime are at large.
