Bhutto case demands high power judicial commission – Hashmat Habib

KARACHI: “We welcome Supreme Court’s decision to take up the presidential reference regarding the hanging of Ex-PM Zulfiqar Ali Bhutto however we apprehend it will prove an exercise in futile.” Hashmat Habib president Tehreek–e- Tahafuz-e-Adlia said in fact the issue is about the cleanness of judiciary from all disputed judgments since DOSU case till to date.
Hashmat Habib said all judges are under oath and bound to function as per constitution and law. Thus no Appeal is provided under the advisory jurisdiction. He said high power commission like Hamood-Ur-Rehman Commission can scrutinize judgement and elaborate report of Supreme Court. Blunders may be unearthed and this commission can also suggest penalty against the judges involved in this national crime so that judiciary stand clean and establish rule of law.
The senior lawyer said; present Chief Justice of Pakistan within one year’s time will be unable to perform his function of protection of independent judiciary and rule of law. But this task shall be handled later or sooner through high power judicial commission to research and resolve the filthy game of judicial corruption playing with rights of the people, otherwise all exercise will be wastage of time and money.
Hashmat Habib said presidential reference regarding Zulfiqar Ali Bhutto is for an opinion under the Advisory Jurisdiction of Supreme Court as per Article 186 of constitution. Keeping this matter pending for a decade has rendered it infructuous because such question of law put by the President is a matter of public importance which requires immediate reply and under clause (2) of Article 186 and Supreme Court is bound to consider a question so referred and report its opinion on the question to the President forthwith enabling him to resolve the issue in the light of Supreme Court opinion.
